Terms of Service
Last updated: 11 October 2026
Smart LP Bot is a software tool, not a financial institution, broker or asset manager. The full agreement follows. Read the risk section in full: money placed in liquidity pools can be lost.
1. Service Description
Smart LP Bot (hereinafter referred to as the "Service", "Bot", "Platform") is an automated software for managing concentrated liquidity (CLMM) positions on the Solana blockchain using the Orca Whirlpools and Raydium CLMM protocols. The Service utilizes artificial intelligence algorithms to analyze market conditions and automatically manage LP positions.
The Service is provided through a web interface (smart-lp-bot.win) and a Telegram bot (@AI_LP_Trade_bot).
The Service is NOT a financial institution, broker, dealer, investment advisor, asset manager, or custodian. The Service is solely a software tool that executes transactions according to predefined algorithms.
2. Acceptance of Terms
By using the Service in any way — including accessing the website, connecting a wallet, using the Telegram bot or Mini App — you unconditionally agree to these Terms of Service and the Privacy Policy.
If you do not agree with any terms of this agreement, you must immediately cease using the Service.
We reserve the right to modify these terms at any time. Continued use of the Service after changes are made constitutes your acceptance of the updated terms.
3. User Eligibility
By using the Service, you represent and warrant that:
- You are at least 18 years old (or the age of majority in your jurisdiction);
- You have full legal capacity to enter into binding agreements;
- You are not located in a jurisdiction where the use of cryptocurrencies, DeFi protocols, or automated trading systems is prohibited by law;
- You are not included on any sanctions lists;
- You understand the principles of the Solana blockchain, decentralized finance, and concentrated liquidity;
- You are solely responsible for compliance with applicable laws in your jurisdiction.
4. No Financial Advice
The Service and all information provided by it (including APY data, profits, market conditions, and AI decisions) are NOT and should not be construed as:
- Investment recommendations or advice;
- Financial, tax, or legal consultation;
- An offer or inducement to buy, sell, or hold any crypto assets;
- A guarantee of profitability or trading results.
All decisions regarding the use of the Service and allocation of funds to LP positions are made solely by the user based on their own analysis and risk assessment. We strongly recommend consulting independent financial and legal advisors before using the Service.
5. Cryptocurrency Risks
Cryptocurrencies are a high-risk asset class. By using the Service, you acknowledge and accept the following risks:
- The value of cryptocurrencies (including SOL, wSOL, and USDC) may fluctuate significantly over short periods. Complete loss of asset value is possible;
- Blockchain transactions are irreversible. Once confirmed, a transaction cannot be canceled or modified;
- Transaction fees (gas fees) are charged by the Solana network and are not controlled by the Service;
- The regulatory environment for cryptocurrencies may change, potentially restricting or prohibiting the use of the Service in your jurisdiction;
- Token values may drop to zero;
- Only invest funds that you can afford to lose.
6. DeFi and Smart Contract Risks
The Service interacts with decentralized protocols through smart contracts. You acknowledge the following specific risks:
- Smart contracts may contain bugs, vulnerabilities, or exploits that could result in partial or total loss of funds;
- Impermanent loss is a natural risk when providing liquidity, occurring when asset values in the pool diverge;
- The Orca Whirlpools and Raydium CLMM protocols are third-party services over which we have no control;
- Protocols may be subject to attacks (flash loan attacks, oracle manipulation, reentrancy);
- Liquidity in pools may change significantly, affecting transaction execution;
- Slippage may result in transactions being executed at less favorable prices;
- Liquidity pools may be subject to manipulation by third parties.
7. AI/Automation Risks
The Service uses artificial intelligence algorithms for trading decisions. You acknowledge the following risks:
- AI algorithms are based on historical data and technical indicators (RSI, MACD, Bollinger Bands) and cannot guarantee prediction accuracy;
- The bot may make suboptimal decisions during extreme volatility, flash crashes, or non-standard market situations;
- Transaction execution delays may occur due to network congestion, RPC node issues, or technical failures;
- Automated trading does not eliminate losses and does not guarantee profits;
- The Service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances;
- Bot strategies (range width, capital allocation) may not match current market conditions.
8. Private Key Handling
For autonomous transaction execution, the Service requires your Solana wallet private key. Automated mode is custodial: the Service holds the key so it can sign transactions on your behalf. You acknowledge and agree that:
- The private key is protected with envelope encryption: each record has its own data key (Fernet), which is wrapped by an AWS KMS master key; the master key never leaves AWS KMS;
- The encrypted key is stored on the server to enable transaction signing; it is decrypted only at the moment of signing and only in memory;
- Records not yet migrated to AWS KMS are still decrypted through the legacy scheme: the Fernet algorithm (AES-128-CBC) with a key derived from a master password via PBKDF2-HMAC-SHA256 (600,000 iterations) with a unique salt for each key;
- With 2FA enabled, money operations require a 2FA code; withdrawals can be restricted to an address whitelist and a daily limit;
- If you connect an external wallet (e.g. Phantom), the private key is not provided to the Service: you sign every transaction yourself, and automated management is not available in that mode;
- Despite encryption, providing a private key to any third-party service carries risk;
- We strongly recommend using a SEPARATE wallet created specifically for the bot, and NOT storing funds exceeding the amount allocated for trading;
- You bear full responsibility for the security of your credentials and wallet;
- In the event of a server compromise, there is a risk of private key exposure: for records under AWS KMS an attacker must decrypt each key through AWS KMS (such calls are logged and access can be revoked); for records on the legacy scheme, the server data and the master password are enough.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- The Service administration, its creators, developers, operators, and affiliates (hereinafter "the Team") shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use the Service;
- The Team's total aggregate liability to any user is limited to one hundred (100) US dollars, regardless of the nature or basis of the claim;
- The Team is not liable for loss of funds resulting from: market movements, smart contract errors, blockchain failures, hacking attacks, third-party actions, technical malfunctions, user errors, or any other circumstances;
- You use the Service at your own risk and bear full responsibility for all consequences of its use.
10. No Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied, including but not limited to:
- Warranties of fitness for a particular purpose;
- Warranties of uninterrupted operation, error-free performance, or security;
- Warranties of profit or any particular level of returns;
- Warranties of preservation of user funds;
- Warranties of accuracy, completeness, or timeliness of provided information.
Past performance of AI algorithms is not indicative of future results.
11. Third-Party Services
The Service interacts with the following third-party services and protocols:
- The Solana blockchain and its infrastructure (RPC nodes, validators);
- Orca Whirlpools — concentrated liquidity protocol;
- Raydium CLMM — decentralized exchange protocol on Solana;
- Jupiter — swap aggregator on Solana;
- Telegram Bot API — for management and notifications.
We do not control, operate, or bear responsibility for the operation of these third-party services. Each of these services has its own terms of use and privacy policy. Failures, changes, or discontinuation of any of these services may affect the functionality of the Service.
12. Service Modifications and Termination
We reserve the right at any time and without prior notice to:
- Modify, update, or alter the functionality of the Service;
- Temporarily or permanently suspend the Service;
- Restrict access to the Service for specific users or jurisdictions;
- Change subscription terms and pricing;
- Discontinue the Service entirely.
In the event of Service discontinuation, we will make reasonable efforts to notify users and provide an opportunity to close open positions, but we do not guarantee such opportunity.
13. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the Service's jurisdiction of registration, without regard to conflict of law principles.
You acknowledge that the legal regulation of cryptocurrencies and DeFi services may vary significantly across jurisdictions. You bear sole responsibility for determining the applicability of any laws, rules, and regulations to your use of the Service.
14. Dispute Resolution
All disputes, disagreements, or claims arising in connection with this agreement or the use of the Service shall be resolved through negotiation.
If agreement cannot be reached through negotiation within thirty (30) days, the dispute shall be resolved in accordance with applicable law.
You waive participation in class action lawsuits and agree to individual resolution of any disputes with the Team.
